Terms and conditions for prize draws at the 4-star Hotel Oberstdorf in the Allgäu region

By participating in the prize draws on the website https://www.hotel-oberstdorf.de, participants agree to the following terms and conditions:

3.1. Registration/Participation

To participate in the prize draw, at least your first name, last name, and email address must be provided. Participants must also confirm that they are at least 18 years old. Participants are responsible for updating this information, especially their email address.

3.2. Eligibility

All persons who are at least 18 years old at the time of participation are eligible to enter. Employees of Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG and their family members are excluded from participation.

3.3. Other Terms and Conditions of Participation

By participating in the prize draw, participants agree to the rules of the prize draw. Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG reserves the right to exclude individual participants for misuse of the rules. The participant agrees that the submitted information, as well as the participant's first name and place of residence, may be published on various social media channels and our website. All natural persons of legal age (18 years or older) are eligible to participate. Employees of the organizer and their relatives are excluded from participation. Participation is only possible within the period specified in the competition description and via the specified method (generally by commenting on the post). Multiple comments will be counted as a single entry; the first comment will be counted. Legal recourse is excluded.

3.4. Determining the Winner

The prize will be awarded as described in the competition. In the event of multiple entries, the winner will be drawn at random, with no legal recourse. Cash payment of the prize value or exchange of the prize is excluded. The prize claim is non-transferable. The winner(s) will be determined no later than one week after the competition ends. The winner(s) will be notified by us via Facebook/Instagram, or as described in the competition. If the winner does not respond to the notification within the specified timeframe, the prize will be forfeited without substitution.

3.5. Delivery of Prizes

The prizes will either be handed over in person or sent to the complete address provided. The prize can only be redeemed by the winner personally and is non-transferable.

3.6. Termination Options

Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG reserves the right to cancel or terminate the competition at any time without prior notice. This applies in particular if the competition cannot proceed as planned for any reason, such as computer virus infections, software and/or hardware errors, and/or other technical and/or legal reasons that affect the administration, security, integrity, and/or proper conduct of the competition.

3.7. Data Protection

The personal data we collect and process is primarily used for processing the competition and for sending newsletters. We naturally comply with all applicable data protection laws valid in Germany.

3.8. Legal Recourse and Liability

Legal recourse is excluded. There is no enforceable right to the payment of prizes. Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG is not liable for the loss, delay, alteration, manipulation, and/or misdirection of emails and/or data during data entry, collection, transmission, and/or storage, which originates in external data networks, in particular the internet or the World Wide Web, external telephone lines, and/or other hardware and/or software of participants and/or third parties; this also applies in particular to faulty, missing, interrupted, deleted, or defective data.

Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG is also not liable for incorrect information caused by participants and/or third parties, their hardware and/or software, and which is used for or related to the prize draw. In particular, no liability is assumed if emails or data entries do not meet the specified requirements and are consequently not accepted by the system.

Furthermore, Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG is not liable for theft or destruction of the systems and/or storage media containing the data, or for unauthorized alteration and/or manipulation of the data in the systems and/or on the storage media by participants or third parties. Hotel Oberstdorf Besitz- und Betriebs GmbH & Co.KG is also not liable for damages incurred by the winner or the winner's relatives in connection with the prize.

3.9 Severability Clause

Should any provision of these terms and conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected. In such a case, the organizer and participants are obligated to cooperate in creating provisions that achieve a result as close as possible to the economic intent of the invalid provision.
