Terms and conditions for Instagram giveaways for the 4-star Hotel Oberstdorf in the Allgäu region

By participating in the giveaways on the Instagram page https://www.instagram.com/hotel_oberstdorf/, participants agree to the following terms and conditions:

Section 1 General

Participation in the giveaway on the Instagram page "Hotel Oberstdorf" is only possible if these terms and conditions are accepted. This giveaway is not sponsored, endorsed, or administered by, or associated with, Instagram.

Section 2 Eligibility

Participation is open to all individuals of legal age (18 years or older) who are legally competent to enter into a contract. Employees of the organizer and their relatives are excluded from participation. By participating, the participant agrees that, in the event of winning, their name and/or image may be published online. Participation is only possible within the timeframe specified in the giveaway description and via the specified method (generally by commenting on the post). Multiple comments will be counted as a single entry; the first comment will be counted. Legal recourse is excluded.

The prize will be awarded as described in the competition rules. In the event of multiple entries, the winner will be drawn at random, and recourse to legal action is excluded. Cash payment of the prize value or exchange of the prize is not possible. The prize claim is non-transferable. The winner(s) will be determined no later than one week after the competition ends. The winner(s) will be notified by us as described in the competition rules. If the winner(s) do not respond to the notification within the specified period, the prize will be forfeited without substitution.

Section 4 Liability

Claims for damages against the organizer in connection with the competition are excluded to the extent permitted by law, regardless of the legal basis, unless the organizer has intentionally or grossly negligently violated legal obligations. Furthermore, the organizer is not liable for damages resulting from disruptions to the availability of the competition website due to technical malfunctions beyond its control, force majeure, or attacks by third parties against the competition website. The organizer will, however, make every effort to ensure the reliability and functionality of the sweepstakes website. Furthermore, the organizer does not guarantee that the sweepstakes website will function properly on each participant's computer.

Section 5 Data Protection

The organizer guarantees the highest possible data protection standards within the framework of the sweepstakes and complies with all relevant legal provisions. The organizer will not forward any personal data to third parties or sell address data. The organizer stores the personal data of each participant exclusively for the purpose of the sweepstakes. The participant hereby expressly declares their consent to the storage and use of the provided personal data for the aforementioned purpose.

Section 6 Severability Clause

Should individual provisions of these terms and conditions of participation be invalid or should a gap exist, this shall not affect the validity of the remaining provisions. The invalid or missing provision shall be replaced by a provision that most closely approximates the intended purpose of the contract and the applicable legal provisions.

Section 7 Jurisdiction / Applicable Law

In the event of disputes, German law shall apply exclusively. The place of jurisdiction shall be the registered office of the organizer, to the extent legally permissible. If the participant does not have a general place of jurisdiction in Germany, or if they move their residence abroad after participation, the registered office of the organizer shall also be the place of jurisdiction.

Section 8 Selection Procedure

In the event of multiple correct answers, the winners will be drawn at random.

Section 9 Premature Termination of the Competition

The organizer reserves the right to modify the competition, cancel, or terminate it without prior notice due to unforeseen circumstances. This applies in particular if software and/or hardware errors occur, and/or other technical and/or legal reasons affect or prevent the regular and proper conduct of the competition.
